Is a seasonal guest a tenant in West Virginia?

West Virginia's factory-built home rental community law covers camping and travel trailers only when they sit in such a community 'on a continual, nonrecreational basis', so recreational/seasonal RV use is outside it, and its written-agreement requirements expressly carve out camping or travel trailers. No statute sets a day threshold for RV guests, so a long-term occupant with a lease-like agreement may be a tenant under general law.

What that means for notices and removal

Not specifically addressed. If a tenancy exists, a month-to-month tenancy ends on one month's written notice (37-6-5) and removal is through the summary 'wrongful occupation' action in magistrate court (55-3A); if the RV is in a factory-built home community on a nonrecreational basis, the longer 37-15 notice rules apply.

Sub-metering electricity to RV sites in West Virginia

No West Virginia statute or PSC rule specific to campground/RV park submetering was found. Check your serving utility's tariff on resale and bill at cost.

Sales and lodging tax on seasonal sites in West Virginia

The county/municipal hotel occupancy tax excludes 'any tent, trailer, or camper campsites' from the definition of 'hotel', and rooms rented for 30 days or longer at inception are excluded anyway. Consumer sales and service tax treatment of campsite rentals should be confirmed with the State Tax Department.

Electronic signatures are valid for seasonal site agreements when the guest agrees to sign electronically, intends to sign, and the record is kept in a form that can be reproduced and shown not to have changed. Recreational use, not a residence"The Site is licensed for recreational use only. The Guest maintains a permanent residence elsewhere at the address above, and the Site is not the Guest’s primary residence. Nothing in this agreement creates a residential tenancy." In this state the line between a recreational guest and a residential tenant is what decides which removal process applies, so say it plainly and keep the guest’s home address on file.
Metered electricity"Electricity is individually metered and billed at the Park’s actual cost per kWh from its utility, with no markup, read on or about the [day] of each month; readings are available to the Guest on request." Keep the utility bills and meter readings for at least three years.
Electronic signature consent"The Guest consents to sign this agreement electronically and to receive invoices, receipts and notices by email at the address above." Keep the signer name, email, date/time, IP address and a fingerprint of the signed text.
