Is a seasonal guest a tenant in Mississippi?

The Act excludes 'transient occupancy in a hotel, motel or lodgings' but does not mention campgrounds or RVs and sets no day threshold. A seasonal or monthly RV occupant who is not transient could therefore fall under the Act's tenant protections.

What that means for notices and removal

Not specifically addressed. If treated as a tenancy, Mississippi's notice and eviction rules apply (e.g., month-to-month tenancies terminated on 30 days' written notice under § 89-8-19; nonpayment eviction through the removal-of-tenant process in Miss. Code Title 89, ch. 7). Use a written agreement that fixes the term and states the site is for recreational use.

Sub-metering electricity to RV sites in Mississippi

No Mississippi statute or PSC rule specifically addressing campground submetering or resale of electricity was found. The PSC service rules require utilities to meter and bill separate premises separately (Rule 10.115) and the only submetering statute located covers water in apartment houses at pro-rata cost (Miss. Code § 77-3-97). Confirm with your electric utility or cooperative whether its tariff permits resale.

Sales and lodging tax on seasonal sites in Mississippi

Mississippi's 7% sales tax on hotels, motels, tourist camps and 'trailer parks' (any location where trailers, campers or other mobile units are parked for a fee) applies to transient guests. A guest is non-transient, and the rental untaxed, only if a written contract or lease covering at least three consecutive months / 90 consecutive days is signed at the start of the stay; guests who simply stay longer without such a contract remain taxable.

Signing agreements online in Mississippi

Electronic signatures are valid for seasonal site agreements when the guest agrees to sign electronically, intends to sign, and the record is kept in a form that can be reproduced and shown not to have changed. Recreational use, not a residence"The Site is licensed for recreational use only. The Guest maintains a permanent residence elsewhere at the address above, and the Site is not the Guest’s primary residence. Nothing in this agreement creates a residential tenancy." In this state the line between a recreational guest and a residential tenant is what decides which removal process applies, so say it plainly and keep the guest’s home address on file.
Notice periodMatch the notice periods in your termination section to the ones the state uses (30-day notice appears in the rules summarized above) rather than inventing shorter ones; a shorter contractual notice is not enforceable where the statute sets a floor.
Metered electricityBill metered electricity at your actual utility cost and say so in the agreement; where a state or utility tariff speaks to resale, at-cost pass-through is the safe harbor everywhere we looked.
Electronic signature consent"The Guest consents to sign this agreement electronically and to receive invoices, receipts and notices by email at the address above." Keep the signer name, email, date/time, IP address and a fingerprint of the signed text.
